Interesses políticos na evolução histórica do Direito Internacional dos Refugiados e no caso ucraniano: entre humanitarismo e seletividade na prática europeia

O artigo analisa a influência dos interesses políticos sobre os processos de criação, interpretação e aplicação do Direito Internacional dos Refugiados, desde o período anterior à Convenção de Genebra de 1951 até a atualidade. Após a análise de momentos históricos relevantes, direciona-se o foco para o caso dos refugiados ucranianos e para a distinção no tratamento conferido a eles, em relação aos refugiados de outras regiões. Questiona-se se o caso ucraniano representaria a continuidade de um processo histórico marcado pela influência política sobre os processos de criação, interpretação e aplicação do Direito Internacional dos Refugiados. A pesquisa foi desenvolvida com a utilização de abordagem qualitativa e método dedutivo, com revisão bibliográfica, partindo de questões gerais para se chegar em conclusões particulares. Concluiu-se que, desde o período anterior à Convenção de Genebra de 1951, interesses políticos vêm exercendo papel central para a criação, interpretação e aplicação das normas sobre refúgio, assim como, para as práticas de acolhimento humanitário exercidas pelos Estados, conferindo-lhes um caráter seletivo, inclusive no caso ucraniano pós-invasão russa.
